That's the thing tho, boning in near a sleeping/unaware child is not mistreatment cause they're not involved in the act meaning they're subject to nothing. They just in the same proximity of the activity, if you see someone get robbed but you yourself didn't get robbed would you consider yourself a victim of robbery? I don't think so, the same applies here obviously having sex isn't a criminal act.
