In a legal capacity, yes. Judge, jurors, and lawyers also have to view material in CP cases all the time and in that context it is legal. There's only a handful of times where viewing CP is 100% legal and that's always within the context of catching a perp.
The journalist that initially had the tape sent to him said part of his dilemma was that if he watched the tape to confirm R. Kelly identity he immediately becomes guilty of viewing child porn...if he passes along to someone else even the police to view he might catch a charge for being in possession of child porn as well. There was no way for this shit to never not be messy as fuck once that tape got out
