On what grounds does the mom have to sue to the police department?

I'm genuinely curious. Because on its face, it looked like a manslaugher charge could've been on the table, since the kid chased the guy out of the restaurant and killed him.

If that is what the police arrested both of them on, how does dropping charges constitute a lawsuit? Someone enlighten me here.
