Putting aside your somewhat flawed reasoning for why the man is at fault, your logic rests on the man being able to think rationally in the moment. The problem with mixing sex and alcohol is that alcohol supposedly can inhibit your thinking process to the point where you can't make a rational decision when it comes to sex.

It's not flawed reasoning it's the reality of the situation. Men don't get the benefit of the doubt when it comes to being victims of sexual assault.

And if you are intoxicated, legally, you can't make decisions. You are not even bound to a contract you signed intoxicated.

Men having sex with intoxicated women are taking risks with their freedom. Especially if she is so intoxicated she can't remember what happened.
