That's what he claims. In the audio in the OP, he's accused of raping the chick multiple times, and he says he didn't rape her because they had already agreed that the sex was going to go down. I don't see how you get that from the story. There was no coercion or finessing based on what he said. The sex was consensual and the agreement took place before any of the extra shit he's admitting to. That's his story, and according to the story it wasn't rape.

Putting aside your somewhat flawed reasoning for why the man is at fault, your logic rests on the man being able to think rationally in the moment. The problem with mixing sex and alcohol is that alcohol supposedly can inhibit your thinking process to the point where you can't make a rational decision when it comes to sex.
