So any repayment would have to come from an allocation of funds through congress...

That still presents legal challenges in itself...there is precedent (reparations for the japanese, jewish, etc) and also again its the congress role to allocate funds so any challenge against it isnt particularly strong...

but cases like these do tend to make it to the supreme court and with a conservative majority anything can happen

thats why reparations sound good but have a .01% chance of ever happening...again it certainly must go through congress. What % congressmen or congresswomen are going answer to voting on spending a trillion dollars on reparations while health care, child leave, opiod and drug treatment, tax cuts to attract business, etc are on the table...the democratic base is very diverse...diverse enough that a sizeable rural and/or blue collar constituency would never go for that which is what bernies point is...

And also, there was Reconstruction. So that means the government saw there was a need to integrate free blacks. Since Reconstruction was stopped, African Americans should be able to sue there, right?
