the way I appreciate Epic's claims is that Alfonso, along with Blockboy J, the backpack kid, and everyone else in the suit, have no basis for copyright as they cannot prove they created the dance and that the suit violates some free speech shit

This is also the issue as I appreciate it. Had the dances just been in the game on their own, no one outside of fortnite even knows about them, but the fact that i think they actually charge real life money to be able to use them has the aforementioned parties upset b/c they are not being financially compensated

I remember reading in one of the threads in the record store how the dudes who made the song "bittersweet symphony" could never recover the devastating lawsuit that they were hit with b/c someone (cant remember who) claimed they used a small section of a song to sample without being cleared. The group testified that they didn't use any of the original song, but i think just recreated it from scratch or some shit. But they still lost and not only did they lose that, they had to give writing credits to the people that sued them.

they said he can’t claim a copyright on it because the dance is basic and doesn’t meet the requirements to be labeled acutal choreography. Therefore he cannot own to sue Fortnite.

They’ve stopped using known dances, now they’re producing their own bc of all the drama behind it.
