Forgive me if this is a stupid question, how does this happen outside of the transfer window?

I think and could be wrong but the transfer window we come to know of is a "European transfer window" so the restrictions and limitations are on clubs within that arena. But for a player to leave to a club outside Europe like this is fine, however European clubs or in this case Everton, couldn't buy even if it was a non-European except the designated windows.

So for instance European clubs can lose players outside their windows to non European but can't buy unless it's within their window.

Also think of when England tried to impose their own transfer system of ending before beginning of their season. It didn't stop clubs buying within Europe until end of August, just limited English clubs.
