I believe Kingpin came back to Marvel with Daredevil when Fox failed to make that sequel.

Who ever has the rights, he would be a better choice to give a villian his own movie. You don't even have to include any super heros. Kind of like they did with joker. Get a great writer and you could make this an excellent mob movie.
