Illinois sues the Trump administration over National Guard deployment to Chicago

The State of Illinois filed a lawsuit Monday in an attempt to block the Trump administration from deploying federalized National Guard troops on the streets of Chicago.

  • On Monday, Illinois sued President Donald Trump, naming him and Homeland Security Secretary Kristi Noem over National Guard deployments into the state against Governor JB Pritzker's wishes.
  • The administration relied on a federalization statute allowing service for invasion or rebellion, and Pritzker announced Sunday that Trump ordered 400 Texas National Guard members for deployment to Illinois and elsewhere.
  • Legal challenges in California produced a district-court finding as U.S. District Judge Charles Breyer ruled in early September that Trump committed a serious violation of the Posse Comitatus Act and rejected the White House's constitutional exception argument.
  • A federal judge in Oregon barred Trump from deploying federalized National Guard troops there, while the 9th U.S. Circuit Court of Appeals said courts must be `highly deferential` to the president, citing Friday's arguments.
  • Nearly four months after initial California deployments, Oregon argued recent small protests near Portland's ICE facility cannot justify unlimited federalization, and Governor JB Pritzker called it `Trump's Invasion

According to the lawsuit,

On September 5, 2025, “Fox News aired a report on Portland ICE protests that included misleading clips from Portland protests in 2020. Shortly thereafter, President Trump appeared to reference events in the same misleading Fox News report when speaking to the press. A reporter asked which city President Trump planned to send troops to next, and he said he was considering targeting Portland because of news coverage the night before. President Trump alleged that ‘paid terrorists’ and ‘paid agitators’ were making the city unlivable, further stating … ‘if we go to Portland, we’re gonna wipe them out. They’re going to be gone and they’re going to be gone fast.’”
