10 Year Old Charged With Assault After Injuring A Student During Dodgeball

Come the fuck on... We played dodgeball growing up. Her kid woulda prolly died playing against one of us 'cause we learned to put bodyweight and fury behind that shit. Gettin blasted in the head or face came with the territory and everybody understood that.

Must have changed over the years. The white boys I knew over that way were quick as fuck to fight and crooked as fuck. Can't see one of them runnin' to the cops for shit.

When you play dodgeball everybody is a target, that's the object of the game! Granted them bitches did hurt but you learn to get the fuck out the way. No way should a 10 year old be charged when it should've been up to the parents to ensure that he's withheld from these type of activities.

That's how they do us though, to quote Chappelle "they always try our 15 year olds as adults. This nigger knew what he was doing..."
 
This is the school's fault not the kids in my opinion.

If the teachers knew this kid had a condition they should've made sure the child wasn't doing anything to put him/her in harm's way. Most kids (including the one with the condition) at that age can't be trusted to restrain or restrict themselves without supervision and it's even harder when all their friends are doing normal stuff kids usually do.

The parent of the hurt child is also in the wrong for pressing charges against the other kid unless the child went out of his way after being told not to throw the ball and he did so anyway. She went to the extreme with this shit and could've at least tried talking with the other kids mother 1st before going the legal route.
 
I met one of my best friends in college freshman year. We had a dodgeball tourney.

I beamed this girl in the head. Man i thought she had a concussion. She got up i checked on her. Said she was good. Next week i saw her on campus we laughed about and been friends since

This falls under the school. It’s their fault. They should’ve been supervising the child, keeping the child away from the area of where they play dodgeball. They stated this has happened before, so when are the adults that are there going to be held responsible? She’s not holding her child responsible, so why hold another with that expectation? The mom also said she tried to keep it from getting to this point, maybe so after two months but when it did get to this point, it only gets here when you want to press charges, why couldn’t she press charges on the school? smh sad. A child being held on a charge that can and will impact him from here on out. You can see the fear in his face. Shameful adults in this situation.

Would be great if a high powered lawyer took the this case pro bono or just accepted as payment whatever the family can truly afford.

The elements for aggravated assault are there. Thing is based on that either dodgeball will be banned from schools in that state or school district or basically balls will be banned from all recess activities and only to be used by supervised/coached sports.

I say that cause with that charge they are going to have to say the ball is/was used as a weapon. So if the ball is a weapon why would the school freely being giving kids unsupervised weapons to play with.

Petty ass lawsuits and charges always lead to some place much further than it was ever intended and fucks up everyone else's fun.

A Michigan prosecutor dismissed an assault charge against a 10-year-old boy who injured a classmate with a ball during a game students were playing at recess.

Cameishi Triplett Lindley said in a Facebook fundraising post last week that her son, Bryce, was suspended from Eriksson Elementary School in Canton Township, Michigan, and then charged with aggravated assault over the April 29 incident.


Wayne County Prosecutor Kym L. Worthy said in a statement Wednesday that although the charge is "certainly sustainable," the case is being dismissed.

"I have no doubt that both families involved love their children and want the best for them. But I do think that there is a better way to go forward at this time," she said in a statement.

"It is my earnest hope that both sides will come back to the table to work out a solution that benefits both of these children."

The incident happened when students were playing a game called tips, according to Lindley's Facebook post. Tips is similar to dodgeball. but instead of throwing the ball at each other, children toss the ball into the air and then jump up and catch it.

Lindley said the ball thrown by her son hit another boy and allegedly resulted in the boy, who is 9 years old, suffering a concussion. According to a police report obtained by WXYZ in Detroit, the boy was hit in the face with the ball.

The injured boy's mother, who did not want to be identified, told the outlet that her son has a medical condition that makes head injuries dangerous. She said her son suffered a black eye and had a bruise on his nose from being hit.

Prosecutors said that the incident between Lindley's son and the other boy happened after the students had stopped playing the game. Lindley's son allegedly "took the ball and intentionally threw it with force" at the other boy, Worthy said in a statement Wednesday.

The charge against Lindley's son was dismissed one day before he was due in court.

The injured boy's mother told WXYZ that her son had been hit with a ball twice before the April incident. Lindley told the outlet she was unaware of those incidents.

A spokesperson for Plymouth-Canton Community Schools told NBC News on Tuesday that the April incident between the two students was handled "in accordance with the applicable district policies and the Student Code of Conduct," and that the district did not contact authorities.
