Black Mafia Family co-founder Big Meech lost another attempt at regaining his freedom on Thursday.
The United States Court of Appeals for the 6th Circuit upheld a lower court's ruling and denied Big Meech's appeal for compassionate release. Meech, real name Demetrius Flenory, was serving his 30-year sentence at Sheridan FCI in Sheridan, Oregon, along with his brother Terry "Southwest T" Flenory.
The brothers filed for compassionate release, in April 2020, arguing that they were at risk of catching the coronavirus. In May 2020, Southwest T was released from his 25-year sentence but the judge denied Big Meech's request.
Despite two previous appeals and proving his conditions were similar to his brother's, the circuit judge argued that Southwest T was released to home confinement instead of receiving a compassionate release, which is a "sentence reduction."
Before upholding the lower court's decision, the court also argued that Big Meech was in better physical condition than his brother, who suffers from blindness, takes daily medication, and wears prescription compression socks. Meech's role as the leader of BMF also made him too much of a risk in the eyes of the appeals court.
"None of the facts about Flenory's brother (or his similarity to Flenory) changes any of the factors the court relied on: namely, protecting the public from further crimes, upholding the seriousness of the offense, promoting respect for the law, and deterring criminal conduct," the judge wrote. "A court does not abuse its discretion by refusing to place sentencing disparity alone above the other factors. The district court did not misapply the law or rely on clearly erroneous facts in finding that Flenory did not show extraordinary or compelling circumstances."
For now, Demetrius "Big Meech" Flenory is expected to remain in prison until 2031. Look above for photos of the court's paperwork.
